LIBRARY SERVICES AGREEMENT

BETWEEN

EASTERN SHORE PUBLIC LIBRARY

AND

CHINCOTEAGUE ISLAND LIBRARY

            This Library Services Agreement (this “Agreement”) is made as of ________, 2008 (the “Effective Date”) between the Eastern Shore Public Library (“ESPL”) and the Chincoteague Island Library, Inc., a Virginia non-stock, non-profit corporation (“Island Library”).

RECITALS

            ESPL is the regional library system serving Accomack County, Virginia and Northampton County, Virginia. Island Library provides library services at Chincoteague, Virginia. ESPL provides certain library services to Island Library in the interest of serving the citizens of Chincoteague and northern Accomack County. ESPL and Island Library wish to set forth their agreement with respect to those services, acknowledging that the needs of ESPL and Island Library may change from time to time, and that this Agreement may be modified accordingly.

AGREEMENT

            1.            Services Provided by ESPL.  So long as funding remains available from public or private sources, ESPL agrees that it will continue to:

            (a)            Make library materials available to patrons of Island Library;

            (b)            Provide cataloging and book processing services for Island Library books, and add such books to the system-wide catalog covering materials of ESPL, Island Library and the Northampton Memorial Library in Cape Charles, Virginia;

            (c)            Provide a permanent copy to Island Library of each best-selling and local book of which ESPL purchases multiple copies;

            (d)            Provide courier service twice a week to deliver and pick up books shared among the Eastern Shore libraries;

            (e)            Maintain the computers at Island Library which were purchased by ESPL and pay for internet access service;

            (f)            Furnish paper, printer cartridges, library cards, request cards, headphones, mouse pads and other miscellaneous office and computer supplies;

            (g)             Provide funding for a minimum of twelve (12) hours per week of library staff time, at the same rate of pay as paid to ESPL employees in comparable positions.

            2.            Library Facilities.  Island Library will continue to own the building housing Island Library. Island Library will pay its operating costs, including, without limitation, utilities, maintenance and insurance. If this Agreement is terminated, ESPL and Island Library will negotiate in good faith to divide the personal property used in the operation of Island Library so that library patrons in the Chincoteague Island area will continue to be served.

            3.            Volunteers.  Island Library will provide such volunteers as may be necessary to provide library services to patrons.

            4.            Books and other Materials.  Island Library will lend books and other library materials to patrons of ESPL and Northampton Memorial Library on the same terms as to its own patrons.

            5.            Term; Amendments.  This Agreement shall be in effect for one year after the Effective Date. Thereafter, this Agreement shall automatically renew for additional terms of one year each, unless and until either party shall give the other party written notice, at least 60 days before the anniversary date of the Effective Date, that it does not wish to renew this Agreement.  This Agreement may be amended from time to time, but only by a written amendment signed by ESPL and Island Library.

            6.            Entire Agreement; Governing Law.  This Agreement sets forth the entire agreement of the parties with respect to the subject matter hereof, and there are no oral agreements between the parties with respect hereto.  This Agreement shall be governed by Virginia law.
